TERMS AND CONDITIONS

When commissioning a portrait or purchasing anything from my website you are agreeing to all terms and conditions listed here. Darren Gwatkin of Gwatkin Artworks does not give permission for any reproduction or useage of images or materials from this website or commissions.

Price Quotation

Darren Gwatkin will provide the Client with a written quotation for the requested artwork. This quotation includes the cost of materials, estimated hours of work, and any additional charges that may apply. Prices are subject to change based on the complexity of the project but will be agreed upon before the commencement of work.

Portrait prices are as per the current published ‘Commissions and Price List' on my website. If prices have increased since the client commissioned a portrait and payed the booking fee, the prices will stay as previous, for said client.

Acceptance of the Commission

Acceptance of the commission must be made in writing (email is acceptable). By accepting the commission, the Client agrees to these Terms and Conditions.

Payment

Booking Fee

A non-refundable booking fee of 25% of the total quoted price is required to secure the commission and begin work. This booking fee will be deducted from the final payment.

Balance Payment

The balance of the payment is due upon completion of the artwork, before shipping or delivery. The artwork will not be shipped or delivered until the final payment has been received. Payment is taken via bank transfer, an invoice will be sent to the Client's email.

 

Please be aware that Gwatkin Artworks works on a first come first serve basis and waiting times can take up to 6 months so please contact Gwatkin Artworks to make sure your portrait can be completed and delivered in the time you need.

Timescale for your commissioned drawing

The completion time for a commission varies and is dependent on the Artist's current workload, the complexity of the commissioned piece, and the size of the artwork. An estimated completion date will be provided when the commission is accepted. However, this is an estimate and not a guarantee. The Artist will ensure they communicate regularly with The Client to keep them up to date with their commission.

Ammendments and Guarantee

Once you receive the sample image for your approval if you are not completely happy then you will not be required to send through the final payment and the portrait will remain the property of Darren Gwatkin (of Gwatkin Artworks).

Once we have agreed the details of your artwork and the booking fee has been received, alterations to the layout and overall basic design cannot be done without incurring additional costs.  A few small (minor) changes can be made within reason. No changes will be made once the finished commission has been approved.

Delivery and Postage

Portraits will be packaged flat.. They will be posted using a tracked service. Most portraits will be posted within 3 to 5 business days of the final payment being made.

All portraits are securely packaged to the highest standard possible, so in the unlikely event of it becoming damaged in transit please photograph the portrait and packaging and email Gwatkin Artworks immediately.

The portrait is to be returned within 14 days of its receipt to Gwatkin Artworks in its original packaging at the clients cost, both ways. Once received, an identical portrait will be created at no additional cost. The lead time will depend on Gwatkin Artworks waiting list at the time of the return.

Returns and exchanges

Due to the artwork and commissions being unique hand drawn pictures Gwatkin Artworks does not accept returns. Every effort will be made to ensure that you are happy with your commission before it is posted to you.

VAT, Import Tax and Duties

If a delivery incurs any import tax, VAT, or duties the customer or client is solely responsible for these payments. Gwatkin Artworks cannot be held responsible for any additional charges which may occur.

Cancellations

The Client may terminate the commission request within 7 days of the initial deposit payment. In such cases, the deposit will not be refunded but may be applied to future commissions. If Darren Gwatkin (Gwatkin Artworks) must cancel the commission due to unforeseen circumstances, the deposit will be fully refunded to the Client.

Photo Provision

For commissions based on photographs, the Client must provide high-quality, clear photos. The quality of the commissioned piece is directly related to the quality of the provided photograph. Darren Gwatkin reserves the right to reject any photo that does not meet the necessary quality standards.

Website Images

Although every effort is made to ensure that images displayed on Gwatkin Artworks website are as accurate as possible to the physical products (prints, mugs etc.), Gwatkin Artworks cannot guarantee an exact colour match to the product displayed on your screen, due to individual screen and colour differences.

Gwatkin Artworks retains copyright to the commissioned artwork form the Client's photo. The Artist reserves the right to share on their social media and website.

Gwatkin Artworks retains copyright to the commissioned artwork form the Client's photo. Darren Gwatkin reserves the right to share the commissioned artwork on social media and for portfolio purposes, unless specifically requested otherwise by the Client in writing.
